How much does a divorce cost in Hong Kong?
There isn’t exactly a flat fee, as it depends on how straightforward things are. If everything is agreed (what’s called an uncontested divorce), costs stay relatively controlled. But if things get tense over money, property, kids and cross-border assets, expect the price to be higher.
Sassy Mama Tip: Some law firms may ask for a retainer (an upfront fee paid to secure their services), which gets drawn down as work is done. If finances are tight, Hong Kong does offer a Legal Aid Scheme for those who qualify, which can significantly reduce legal costs, alongside other support and assistance programmes.

How long does it take?
Timing depends heavily on whether you and your spouse are on the same page. Uncontested divorces usually range from 9 to 12 months, whilst contested divorces can often take 12 months or more (sometimes significantly longer if disputes go to hearings or require multiple court applications). Even when things are amicable, the court process and paperwork itself can still take some time.

What are the divorce rules in Hong Kong?
Divorce in Hong Kong is governed by the Matrimonial Causes Ordinance. The core requirement is showing that the marriage has broken down irretrievably. That can be proven through one of five grounds:
- Adultery
- Unreasonable behaviour
- Separation for 1 year (with consent)
- Separation for 2 years (without consent)
- Desertion
When children are involved, the court’s priority is always the children’s best interests, especially regarding custody, care arrangements, and financial support. Assets and finances are typically divided based on fairness rather than a strict 50/50 rule.
